The Fox Run Homeowners' Association Board met at 7:00 PM on 26 March 2007. Attending were Jack Hampson, Karen Ewing, Mike Ryon, Scott Gibson, Nancy Wentz, Rod Langman, Yvonne Kidder, and Deb Szwarc.

1. Capital Projects: An architect presented general information on building a club house. He also shared some pictures and layouts. Board members discussed general design features that should be included.
2. Financial/Budget Report: Nancy Wentz presented the financial report.
3. Covenant Issues: The Fox Run Homeowners Association Board routinely follows up when notified of a covenant violation and unresolved violation issues are few in number, however, those that do exist must now be addressed. Rod Langman presented information to the Board members on the procedures that will now be used to address covenant violations. We are no longer going to send multiple notices to violators. We currently have two violations where we have had a commitment from the residents to resolve the issue by or before this Spring and we have one resident who, despite multiple attempts by the Board to gain cooperation, has refused to remove a trailer from view. If these and, potentially, other violations are not resolved soon or as agreed upon, the Board will take legal action to force compliance. If legal action is pursued, the following will occur:
The violations, legal actions, and the names of the residents involved will be fully disclosed to all Association members.
Costs incurred by the Association to enforce the covenants will be assessed against the covenant violators if the legal action is successful.
Assessments not paid will result in a lien on the property. (This also is applicable to excessively late annual dues payments).
Jack Hampson volunteered to develop a spread sheet for covenant violations. Other Board members will provide input.
4. Insurance: Scott Gibson had been notified by the Fox Run insurance carrier that they could not cover the officers and directors of the Association as long as individuals other than residents can serve on the board.
Per Article IV, Section 1 of the current Fox Run By-laws "the affairs of this Association shall be managed by a Board of not less than three (3) nor more than nine (9) directors, who need not be members of the Association."
After discussion, the Board members decided to change Article IV, Section 1 of the By-laws. Scott Gibson will draft the change and have the other Board members review the change. All members (residents) will be given notice of the proposed by-law change prior to the annual meeting in May at which time the change will be voted on.
5. Vandalism/Neighborhood Watch: Jack Hampson announced that the new security lights and motion detectors will be installed in a few weeks.
6. Facilities - Swimming Pool: The small swimming pool will be drained and repaired. This work will start on April 25. Pro Pools will be forming the work.
Pool management: There have not been enough volunteers to clean the pool facilities on a daily basis for this summer. ACTION ITEM : Deb Swarc will meet with Gordon Hughes to determine what actions should be taken to for cleaning the pools.
7. Annual Meeting: Board members recommended that the Fox Run Homeowners Association Annual Meeting be held on Friday, 11 May.
