Recent news stories show that the vast majority of Tennessee citizens want smokefree air in restaurants and other public places. This right is being won in communities across the nation, including Lexington and Louisville in the neighboring tobacco state of Kentucky. Legislators in Georgia and Florida have passed statewide bans on smoking in restaurants, showing more concern for their constituents than for the big tobacco industry which profits from their suffering (not to mention government-subsidized health care for the diseases caused by exposure to tobacco smoke).
News stories listed on this page focus primarily on Tennessee and surrounding states. In Tennessee, our legislators are letting us down by perpetuating a state law which actually prevents us from protecting our families from toxic tobacco smoke. Under TCA Section 39-17-1551, it is illegal for a city, town, or county in Tennessee to protect the rights of its citizens to breath smokefree air. That's as ludicrous as having a state law preventing the county health department from conducting hygiene inspections in restaurants.

Several businesses made the decision to designate themselves as "smoking" or "non-smoking" months ago.
The Cracker Barrel Restaurant on Alabama Highway 157 North, which had provided both smoking and non-smoking sections, has posted a sign at its front entrance which states that the restaurant and Old Country Store is smoke-free.
Just down the street, Denny's, which previously permitted smoking, has smoke-free signs posted outside and inside the restaurant.
Denny's Manager Gisela Daza said business dropped off in the first month after the decision was made to go smoke-free, but noted that the trend is beginning to show signs of reversing.
"In the first month business was down, but it's now beginning to pick up again," Daza said. "We've heard a number of complaints from customers who smoke. I smoke, so I understand. We've also heard compliments from customers who say they are glad we decided to go smoke-free. There is only one Denny's in Cullman. The food is good so my hope is that any customers we lost in the beginning will be back after the shock wears off."
Daza said she was working at a Denny's in California in 1989 when the state went smoke-free.
"After two or three months the customers began to come back and eventually business was better than before," Daza said. "I later transferred to Seattle, Wash., and the same thing happened there. I expect it to be the same here. Once the initial shock wears off the people will be back."

Last week, USA Today reported that 2,000 cities have adopted indoor smoking bans and efforts are under way to restrict outdoor smoking, especially to remove the clouds of smoke from doorways were smokers often congregate.
While the rest of the world seems to be moving to combat smoking, state policies lag.
State lawmakers still bow to the powerful tobacco lobby and have defeated efforts to raise the tobacco tax, one of the lowest in the nation. Polls show consistent public support for increasing the tax.
Smoking not only causes disease and kills the people who engage in it, but ultimately costs everybody. Our tax and public smoking policies should reflect that with more restrictions.Smoke-free Starkville?

The Mountain Press, Sevierville, Tennessee, 6 October 2005The board also unanimously approved a resolution asking the state legislature to give local governments the authority to regulate smoking at businesses, including restaurants.
Bryant noted that power laid with local governments until a few years ago, when the Legislature took the authority after a lobbying campaign by tobacco companies.
The American Cancer Society has asked local governments to push the Legislature to regain that authority, Bryant said, adding that it doesn't mean the board is planning to ban smoking at local establishments.
"We're not proposing to do anything right now," he said.
