Recent news stories show that Tennesseans overwhelmingly support smokefree air in restaurants and other public places. Smokefree environments have come to communities across the nation, including Lexington and Louisville in the neighboring tobacco state of Kentucky. Legislators in Arkansas, Florida, Georgia, and Louisiana have passed statewide bans on smoking in restaurants, showing more concern for their constituents than for the big tobacco industry which profits from their suffering and contributes to the rising cost of government-subsidized health care for the diseases caused by exposure to tobacco smoke.
News stories listed on this page focus primarily on Tennessee and surrounding states. In Tennessee, our legislators are letting us down by perpetuating a state law which actually prevents us from protecting our families from toxic tobacco smoke. Under TCA Section 39-17-1551, it is illegal for a city, town, or county in Tennessee to protect the rights of its citizens to breath smokefree air. That's as ludicrous as having a state law preventing the county health department from conducting hygiene inspections in restaurants.

Ive sat on our board for 10 years and remember debating this on private property rights. I think the general consensus is we just want a level playing field. If were going to go to a smoke-free environment, make it smoke-free for everybody.
What do you mean by a level playing field?
It has to do with geography. I get concerned when I see municipalities or townships taking initiates that impact a particular geographical area. And then once youre outside of that area, its administered by a different regime. An initiative like that needs to be statewide. To me, those kinds of issues are better debated at the state legislative levels than the city councils. The same with wage and hour mandates. I think those are things that should not be debated at the city level.

The scientific community has established beyond doubt that smoking is hazardous to both the smoker and his neighbors. The government and the public bear the consequences of tobacco usage through higher health and related costs. The governmental interest in protecting the general public from further health risks clearly outweighs any alleged chilling of individual rights to smoke in public, the judge concluded.
