Rules and Regulations

Limited Common Property = property owned by the TVTA in townhouse areas

EXTERIOR AND GROUNDS MAINTENANCE POLICY

  1. TVTA maintenance is intended to keep townhouse landscaping consistent and well groomed and consistent within each neighborhood. The TVTA maintains the Limited Common Property trees, shrubs, mulched beds and grass consistent with TVTA standards.  This includes providing the chemicals for the lawns as necessary, trimming the shrubs, installing mulch and removing dead shrubs or trees.  Removal of dead shrubs or trees does not include replacement within the five (5) foot area outside the “foot print”.
  2. A townhouse owner’s property is defined as the driveway and five (5) feet outside the “foot print” (foundation outline including patio, porch, garage or carport) of the townhouse. It is the responsibility of each townhouse owner to maintain the landscaping on the owner’s property.  At the discretion of the Board, TVTA will provide mulching, limited seasonal trimming and shaping of shrubs.
  3. Repainting the exterior of the townhouse is the townhouse owner’s responsibility.  Repainting is scheduledby the TVTA and owners must comply with TVTA’stime table, color selection and specifications.  TVTA reserves the right to inspect completed work and may call for corrective action when appropriate. If an owner does not comply, the TVTA Board can elect to arrange for painting. TVTA will then charge the owner the cost of painting the unit plus an administrative fee of up to 25% of the job cost.  If the owner does not pay the bill, the TVTA Board will place a lien against the townhouse property for the cost of the painting plus legal and administrative fees.
  4. As stated in the Tellico Village Property Owner’s Handbook, maintenance and replacement of mailboxes and posts are the responsibility of the owner.  Additionally, neighborhood mailbox posts should have matching colors.
  5. TVTA re roofing philosophy has been to encourage cooperation among owners in multiunit buildings to reroof at the same time in order to maintain a consistent appearance. Townhouse owners should use similar materials and colors as those originally installed so they coordinate with the neighborhood color scheme.  Multi-unit buildings should try to re-roof at the same time.  Owners are encouraged to talk to each other or confer with TVTA.  As a minimum, TVTA wants contiguous planes to be re-roofed at the same time in order to avoid non-matching roof colors for a given building and neighborhood.
  6. Changes to landscaping on Limited Common Property, whether requested by and funded by an owner or a local residents association, must be approved in advance by the TVTA Board of Directors. The owner or group requesting approval may be required to maintain the approved landscaping changes.  The TVTA Board of Directors may invest in new or replacement landscaping projects in order to maintain the aesthetic quality of a neighborhood.  Maintenance in these areas will be the responsibility of TVTA.
  7. “Jungle gyms” and other recreational equipment, doghouses, fences, and other additions are prohibited.
  8. Townhouse neighborhood entrances will be maintained by TVTA in the following manner:
    • Maintain signage, grass, shrubs and trees
    • Provide mulching for beds
    • Remove and replace dead plantings

Any other maintenance or revisions of Cooper Homes-installed additional decorative enhancements such as, bridges, fountains,decorative landscaping beds, etc. is the responsibility of local townhouse associations.

Complaints regarding the services of the TVTA and / or violations of Rules and Regulations shall be made in writing and mailed to the TVTA Board of Directors at 298 Village Square #105; Loudon, TN 37774.

 

                                                                                RULES AND REGULATIONS

  1. All personal property of townhouse owners or their renters or guests shall be stored within their units and not on Limited Common Property.
  2. Garage doors shall be kept closed except when required to be open for entering or leaving and when an owner or resident is present in the immediate area.
  3. Driveways, sidewalks, walkways and entrances must not be obstructed or used for any purpose other than entering or leaving.
  4. Patios and decks shall be kept free of items such as laundry, mops, refuse, or any unsightly materials.
  5. Each townhouse owner must provide a trash container and retain an approved TVPOA service to pick up garbage and trash.  Townhouse owners are responsible for the upkeep of their container(s) and, where applicable, trash container enclosures.  The container(s) are not to be placed outside until the evening before the scheduled collection.  All containers, including recycle boxes, must be returned to their proper location (enclosure, garage, or carport) as soon as possible after the collection by the service.
  6. No owner shall store or leave boats, trailers, mobile homes, recreation vehicles, buses and the like for a period exceeding three (3) days, except in garages or other areas permitted for them.
  7. Activities or noises that interfere with the rights, comforts, or convenience of the majority of other townhouse residents are not permitted.  Musical instruments or devices, televisions, radios, or other sound amplifiers shall be played or operated in such a manner as not to disturb other residents.
  8. No sign, advertisement, notice or other lettering shall be exhibited, displayed, inscribed, painted or affixed in or upon any part of the limited common property.
  9. No flammable, combustible, or explosive fluid, chemical or substance shall be kept in any unit except as required for normal household use.
  10. Use of fireworks is prohibited in all townhouse areas.
  11. The use of skateboards, mopeds, scooters or any mechanized vehicles for racing or other sports activity within townhouse areas is prohibited.
  12. In order to preserve continuity of appearance in each neighborhood, changes in the exterior appearance of individual units (including re-roofing, awnings, garage doors, spas/hot tubs, etc) are not permitted unless approved in advance by the ACC and the TVTA Board of Directors.  The following describes the exterior modification approval process and procedure:
  • Obtain an application for change from the ACC at the POA office
  • Complete form and return to ACC for approval with processing fee
  • At the same time, request an approval letter from TVTA.
  • TVTA will review the request to assure that neighbors' view and privacy are considered in the
    final design and acceptable to them.
  • TVTA approval letter is sent to ACC.
  • Applicant is notified of outcome by ACC.
  • ACC issues approval and/or permit as required.

Reminder - The cost of any repairs to or replacement of infrastructure, plantings, etc. is the owner’s responsibility.  In the event an owner or an owner’s contractor damages or in any way negatively impacts the limited common property as a result of home improvements, repairs, or other actions, the owner is responsible for restoring the limited common property to its original condition.  If the owner does not comply within 30 days of notice of required action, TVTA reserves the right to complete the repairs and assess the owner for the cost of the work plus an administrative fee of up to 25% of the job cost.

  1. The TVTA Board of Directors and the TVPOA ACC must approve the use of a Tellico Village townhouse for business or service by the owner or other resident in advance.  Each application must include the type of business service, the qualification of the practitioner, the anticipated number of clients per month, and the number of clients at each activity.  The decision criteria for approval will be the effect of this activity on the neighborhood (i.e., the creation of traffic problems, availability of parking off the street, and noise).
  2. Tellico Village is subject to leash laws enforced by Loudon County.  Additionally, consideration for neighbors should be the rule with regard to supervision and containment of pets.  Residents are reminded that cats and dogs are not always welcome in other’s yards or in common areas. It is the residents’ responsibility to clean up after their pets.

Except for Neighborhood Captains, owners/residents should refrain from directing, supervising or in any manner asserting control over TVTA employees or contractors. Interaction between townhouse owners/residents and TVTA employees or contractors should only occur in the presence of a Townhouse Board Member or Neighborhood Captain.
